The plaintiff's rig, ENSCO 64, located 90 miles south of the coast of Louisiana in the Gulf of Mexico, was severely damaged by Hurricane Ivan in September 2004. The plaintiff entered into a contract with the defendant salvage company to salve the legs and other pieces of the rig and deliver them for repair in Brownsville Texas. Both the plaintiff and the defendant were US corporations.
