On 4 February 2009 the fishing vessel Catone grounded outside the port of Lampedusa, Italy. Various tug companies, including the claimant, were contacted with a view to hiring a tug to assist in refloating the Catone , and a contract was eventually concluded on 4 February 2009 between the claimant and the owners of the Catone for the hire of the claimant’s tug Posejdon .
