Extradition – Bill of lading fraud – Hong Kong government seeking extradition of couple alleged to be complicit in fraud by company involving creation of bogus bills of lading – Whether extradition should be refused on basis of passage of time

(2009) 762 LMLN 3

The appellants, Mr and Mrs Raichandani, had lived in London since April 2000. They had left Hong Kong, separately and in a hurry, in December 1998, when their company, Suzika Electronics Co Ltd (“Suzika”) collapsed. Suzika manufactured electronic goods and shipped them to overseas customers. Subsequent criminal proceedings in Hong Kong (not against the appellants) established that Suzika had been engaged in widespread fraud.
