On 17 July 2009 Orient Shipping chartered the Bavarian Trader to Pancoast. Orient Shipping was described for the purposes of the charter as the disponent owner of the vessel. Pancoast gave instructions to the vessel to load a cargo for discharge inter alia at Dar es Salaam, Tanzania but the master refused to do so, relying on the trading exclusions in clause 55 of the charterparty that there would be:
